Welcome to Chosen Souls. These Terms of Service ("Terms") govern your access to and use of chosensouls.store and any related services, content, features, tools, products, and transactions offered by Chosen Souls LLC ("Chosen Souls," "we," "us," or "our"). Our online store is powered by Shopify.

By visiting, browsing, creating an account, or purchasing from our store, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility and Accounts

By using the Services, you represent that you are at least the age of majority in your state or province of residence, or that you have permission from a parent or legal guardian where required by law.

You agree to provide accurate, current, and complete information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs through your account.

2. Products and Product Information

We make reasonable efforts to describe and display our products accurately. Colors, textures, print placement, and other visual details may appear differently depending on your device, display settings, garment-dye characteristics, or normal production variation.

Product descriptions, pricing, availability, colors, sizes, and other details may be updated without notice. We may discontinue products or limit quantities available for purchase at any time, subject to applicable law.

3. Orders and Acceptance

Submitting an order is an offer to purchase. We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including for suspected fraud, pricing or listing errors, payment issues, product availability, or shipping restrictions. An order is accepted when we confirm it for processing.

Please review your order carefully before submitting it. Because many items are produced or prepared for fulfillment shortly after an order is placed, we may not always be able to accommodate changes or cancellations after processing begins.

Returns and exchanges are governed by our Refund Policy.

4. Prices, Payment, and Taxes

Prices and promotions may change without notice. The price charged will be the price shown at checkout when your order is placed, subject to correction of obvious errors as permitted by law.

Unless otherwise stated, product prices do not include shipping charges, taxes, duties, customs fees, or other charges that may apply. You agree to provide accurate billing and payment information and represent that you are authorized to use the payment method provided.

5. Shipping and Delivery

Processing and delivery timeframes are estimates and are not guaranteed. Carrier delays, weather, customs processing, incorrect addresses, and other circumstances outside our reasonable control can affect delivery times.

Shipping methods, rates, processing expectations, and tracking information are described in our Shipping Policy. If a shipment is lost, delayed, damaged, or otherwise affected in transit, contact us at support@chosensouls.store and we will assist as reasonably possible.

6. Returns and Refunds

Eligibility, timeframes, return shipping responsibilities, and procedures for damaged, defective, or incorrect items are governed by our Refund Policy.

7. Intellectual Property

The Services and their content, including trademarks, logos, brand names, product artwork, graphics, photographs, text, videos, designs, and site elements, are owned by or licensed to Chosen Souls LLC and are protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial purposes only. Unless we give prior written permission, you may not reproduce, distribute, modify, republish, sell, exploit, or create derivative works from our protected content or use our trademarks, designs, or branding in a way that implies affiliation or endorsement.

To the fullest extent permitted by law, we are not responsible for third-party services that we do not control.

10. Relationship with Shopify

Our online store is powered by Shopify, which provides the commerce platform that enables us to offer the Services. Purchases made from Chosen Souls are transactions between you and Chosen Souls LLC. Shopify is not the seller of our products and is not responsible for our products, order fulfillment, customer service, or other obligations arising from your purchase, except to the extent required by applicable law or separately provided by Shopify.

11. Privacy

Our collection, use, and disclosure of personal information is described in our Privacy Policy. Because our store is hosted by Shopify, Shopify may also process information in connection with providing its platform and services.

12. Reviews, Feedback, and Submissions

If you voluntarily submit reviews, suggestions, photographs, testimonials, ideas, or other content to us ("Feedback"), you represent that you have the right to provide it and that it does not violate applicable law or the rights of others.

Unless otherwise agreed in writing, you grant Chosen Souls LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and share Feedback for operating, improving, and promoting our business and Services. We are not obligated to keep Feedback confidential, compensate you for it, or publish it.

13. Errors, Inaccuracies, and Omissions

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, availability, shipping charges, or transit times. We may correct or update such information and, when permitted by law, cancel or adjust affected orders.

14. Prohibited Uses

You may use the Services only for lawful purposes. Except for warranties that cannot legally be excluded, Chosen Souls LLC disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes or limits any rights or warranties that cannot be excluded or limited under applicable consumer protection law.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Chosen Souls LLC and its officers, employees, contractors, service providers, affiliates, and licensors will not be liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, lost revenue, lost data, or replacement costs, arising from or related to your use of the Services or products purchased through the Services.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot legally be limited.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Chosen Souls LLC and its affiliates, officers, employees, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable costs arising from your material violation of these Terms, your unlawful use of the Services, or your infringement of another person's rights.

19. Severability

If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law and severed to the extent necessary. The remaining provisions will remain in effect.

20. Waiver and Entire Agreement

Our failure to enforce any provision of these Terms does not waive our right to do so later. These Terms, together with policies incorporated by reference, constitute the agreement between you and Chosen Souls LLC concerning your use of the Services, except where additional terms expressly apply.

21. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations in connection with a merger, reorganization, sale of assets, or other lawful business transfer, subject to applicable law.

These Terms are governed by the laws of the State of Arizona and applicable federal law, without regard to conflict-of-law principles, except where mandatory consumer protection laws require otherwise. To the extent permitted by applicable law, disputes arising from these Terms or the Services will be brought in courts with appropriate jurisdiction in Arizona.

We may update these Terms from time to time to reflect changes to our Services, business practices, or legal requirements. The current version will be posted on this page with an updated revision date. Your continued use of the Services after an update becomes effective constitutes acceptance of the revised Terms to the extent permitted by law.
